Terms and Responsible Testing
Defined scope. Authorized systems. Reversible actions.
These terms explain use of this website and the boundaries ViaLayer applies when evaluating customer tasks.
1. Website use
You may use this website for lawful business information and to contact ViaLayer. You may not attempt to disrupt the site, bypass security, misuse forms, introduce malicious code, scrape the site in a way that harms its availability, or use the content to facilitate unlawful activity.
2. Informational content
Website content is general information about ViaLayer’s current approach. It is not legal, security, financial, accessibility, or technical assurance advice. A website page does not replace a written proposal, statement of work, or service agreement.
3. No universal performance guarantee
Agent behavior can vary by AI system, browser environment, website state, time, and network conditions. A Readiness Check is a point-in-time observation of the named task and tested conditions. ViaLayer does not guarantee that every AI system will produce the same result or that a result will remain unchanged.
4. Authorization and scope
The client must have authority to request testing of the website, form, booking path, or other system in scope. ViaLayer and the client should agree the target, customer task, success condition, allowed actions, prohibited actions, stopping point, and handling of any test submission before testing that could affect a live system.
5. Responsible-testing boundaries
Unless a separate written procedure explicitly authorizes otherwise, ViaLayer will not:
- complete a payment or financial transaction;
- accept a contract or create a legally binding commitment;
- place an order, cancel a service, or change an account;
- circumvent authentication, access controls, rate limits, or security measures;
- exploit a vulnerability or attempt to obtain unauthorized data;
- intentionally impair availability or interfere with customers, employees, or operations; or
- take another destructive or irreversible action.
6. Forms, quotes, and bookings
Where a controlled submission is necessary and authorized, the scope should identify the submission, permitted contact details, test label, expected downstream handling, and cleanup responsibility. The test stops at the agreed boundary. If a task unexpectedly reaches a payment, legal, sensitive-data, or irreversible step, the test stops and the condition is reported.
7. Client responsibilities
The client is responsible for accurate instructions, authority over the systems it asks ViaLayer to test, required notices to its staff or providers, and timely disclosure of restrictions that affect testing. The client should not provide credentials or sensitive personal data unless they are required by an approved scope and an appropriate handling procedure is in place.
8. Evidence and confidentiality
ViaLayer may create limited evidence necessary to support the agreed result. Public use of a client’s identity, logo, screenshots, quotes, results, or case study requires separate explicit written permission. Confidentiality, ownership, permitted use, and retention for paid work should be defined in the applicable written agreement.
9. Intellectual property
The ViaLayer name, website copy, design, and original materials are protected by applicable intellectual-property laws. Rights in client materials, custom deliverables, and pre-existing tools should be specified in the written agreement for paid work.
10. Paid services
Paid services begin only after an approved written scope or service agreement. That document should control where it conflicts with general website content and should address fees, deliverables, changes, access, confidentiality, warranties, liability, governing law, and dispute terms appropriate to the parties.
11. Liability
To the extent permitted by applicable law, this website is provided on an “as available” basis without a promise that it will always be uninterrupted or error-free. Appropriate warranty exclusions and liability limits for paid work must be stated in the signed agreement and reviewed for the governing jurisdiction.
